General Terms and Conditions

1. Identification of the contracting parties
The contracting parties of the General Terms and Conditions are Stallerbike Unipessoal Lda RNAAT 284/2012 (with registered office at Quinta Martini 155X Matos de Baixo 8200-486 Paderne) as the first contracting party, and the customer as the second contracting party.

This contract is concluded between the company and the customer (in these terms ‘Stallerbike’ and ‘customer/participant’).

These terms and conditions are subject to Portuguese law.

2. Booking and payment terms

2.1 Any booking will only be guaranteed once payment has been made in full. All customers (including those added or substituted at a later date), whether they book in person, by telephone, via the official website, by email or by any other means, agree to the following terms and conditions:

2.1.1 The customer(s) have read and accepted the booking conditions and general information described on the official Stallerbike website.

2.1.2 The customer(s) are aware of the risks of the booked tour and accept them;

2.1.3 The customer(s) declare(s) that he/she does not suffer from any pre-existing disability or medical condition that would prevent him/her from actively participating in the tour. If there are any restrictions or disabilities, Stallerbike must be informed in order to assess any needs and requirements.

2.1.4 The person responsible for the booking confirms that they are of legal age and have full authority to enter into a contract based on the terms and conditions described in this document. On behalf of other persons named in the booking, he/she confirms that these persons have been duly informed and are aware of these conditions and accept them.

2.1.5 A booking is only accepted and considered final from the date that the corresponding invoice/receipt is issued by Stallerbike or the authorised agent. It is only at this point that the contract between the two parties is deemed to have been concluded. An online request is not considered a booking confirmation. Stallerbike reserves the right to increase or decrease the price of an activity booking or holiday package until your request is confirmed and the contract is signed.

2.2 Accepted payment methods:

2.2.1 in cash.

2.2.2 by bank transfer to the bank account of Stallerbike.

2.2.3 by Paypal, where a surcharge of 3.5% will be levied.

3. Cancellations and refunds

3.1 Cancellation at the initiative of Stallerbike (Stallerbike reserves the right to cancel a programme or activity in the following circumstances):

3.1.1. Force majeure: war or threat of war, terrorism, strikes, fire, natural disasters and other similar situations for which Stallerbike is not responsible. In these cases, there is no right to a refund of payments already made. If circumstances permit, Stallerbike will offer the customer an alternative programme that is as similar as possible to the cancelled programme.

3.1.2 Extreme weather conditions that endanger the safe execution of the activity. In this case, there is no right to a refund and Stallerbike undertakes to offer a similar tour on an alternative day.

3.1.3 Programmes with a minimum number of participants – if the minimum number of participants set for the programme is not reached. In these cases, the registered participants can choose one of the following options: a refund of the amount paid; a new price for a reduced group or (if possible) an alternative programme for the amount already paid.

3.1.4 Stallerbike reserves the right to change the programme or pre-arranged routes whenever it deems necessary: road or path works; impassable paths; for safety reasons, etc. In these cases, no refunds will be given.

3.1.5 In the unlikely event that Stallerbike is forced to cancel a programme for any other reason not mentioned in the previous points, 100% of the amount paid will be refunded.

3.2 Cancellation at the customer's initiative (corporate or group tours)

3.2.1 Up to 28 days before the start of the tour, the customer will receive a refund of 100 percent.

3.2.2 Between 27 and 14 days before the start of the tour, the customer will receive a refund of 50 percent of the total amount paid.

3.2.3 From 13 days before the start of the tour, no refunds will be considered.

3.2.4 No refunds will be given after the start of the tour. There are no exceptions, including weather or other factors beyond the control of Stallerbike.

3.2.5 Exceptions: In the event of illness of the participant (proven by an official medical document), the tour can be postponed to another available date. However, costs may be incurred that are imposed by any company that may have been booked.

3.3 Cancellation for individuals

3.3.1 For cancellations up to 24 hours before the start of the tour (for bike tours and minibus tours) and 48 hours (for boat tours), the payment made by the customer will be refunded minus the fees. After that, there will be no refund. If the fee has not yet been paid, Stallerbike is authorised to charge it to the hotel bill. The same applies to ‘no shows’.

3.3.2 Once the tour has started, there will be no refund. There are no exceptions, including weather or other factors beyond the control of Stallerbike.

4. Risks and responsibilities

4.1 The difficulty level of the tours is defined in each programme proposal. If you have any questions, please contact us.

4.2 When a customer books a tour, they are required to inform Stallerbike before the tour of any health issues and/or physical conditions that could be affected by the activity or that could affect the normal course of the activity.
During the tour, it is mandatory to inform the tour guide of any health issues, e.g. overloading.

The customer(s) are aware of the risks of the booked tour and accept the possible risks associated with an outdoor activity that requires physical exertion and/or takes place in remote locations, as in our case, cycling. The person responsible for the booking confirms that all participants booked by him/her are physically able to complete the chosen programme.

5. Compulsory insurance and liability

5.1 All activities of Stallerbike Unipessoal Lda. are covered by liability and accident insurance with the legally required coverage.

6. Responsibilities

6.1 Stallerbike is not liable for any damage or accidents that occur during the programmes. We recommend that participants take out private liability and accident insurance.

6.2 All programmes are conducted by qualified staff.

Procedure in the event of an accident: In this case, if necessary, the emergency services will be notified. The costs of transport to the hospital are to be covered by the participants. If the emergency services do not consider an ambulance necessary, you will have to pay for a taxi, which may not be reimbursed by the insurance. The hospital costs are to be covered by you. Stallerbike will provide a report to the insurance company.

7. Participation in the tour and responsibility of the CLIENT

7.1 The client agrees to accept the authority and decisions of the staff and representatives involved in the activities offered. If these persons believe that the customer is not in good health or physical condition or is behaving in a manner that could endanger their own or others' integrity, the customer may be excluded from participating in the tour without entitlement to a refund. After exclusion from a tour, Stallerbike is not liable to the customer in any way.

7.2 If the customer commits an illegal act (including causing damage to third parties), the customer may be excluded from the tour. In this case, there is no right to a refund for unused services. When the customer books a tour, they agree to be responsible for any damage or loss caused by themselves or by any person included in their booking/group. In this case, the full amount for the damage or loss caused (estimated or approximate price if it is not possible to state the exact amount) must be paid as quickly as possible directly to the responsible person or the owner. If this does not happen, STALLERBIKE is authorised to add the amount to the hotel bill.
The customer is also responsible for settling all claims that are later asserted against Stallerbike, as well as for all costs that Stallerbike incurs as a result of the customer's actions (including their own legal and other costs).

7.3 It is the customer's decision and responsibility to take out appropriate travel insurance that will protect them in the event of the above situations occurring.

8. Changes to the programme or itinerary

8.1 Stallerbike reserves the right to make any changes it deems necessary. We will endeavour to ensure that any necessary changes do not alter the character of the tour or its structure, duration and quality.

9. Photographs, images and processing of personal data

9.1 By confirming the booking, the customer accepts that Stallerbike has the right to take pictures, photos and videos during the tours and activities for advertising and marketing purposes only. No images will be used in which a person occupies more than 50% of the total area of the photo or video.

9.2 All personal data collected by Stallerbike is provided voluntarily and will not be passed on to third parties, unless the customer has given permission to do so or in cases expressly stated in the contract. The collected data may be used until further notice for promotional purposes carried out by Stallerbike (e.g. newsletter).
